Definition of IPC 338:
Causing grievous hurt by act endangering life or personal safety of others.

This section is Bailable, Cognizable and Compoundable.
Triable By :
Any Magistrate
Punishment :
Imprisonment for 2 years, or fine of 1,000 rupees, or both.
Sir / Madam, I feel that such offence should not be bailable , accident by rash driving , licence be cancelled. No fault of person met with an accident who loss the life his / her parents suffered a lot can not be companset by money and or injusred seriously.
It shud be revised to give stern punishment to rash driver
