Intentional omission to apprehend on the part of public servant bound to apprehend person under sentence or lawfully committed.

According to Para 1 and 2 – This section is Non-bailable, Cognizable and Non-compoundable.
According to Para 3 – This section is Bailable, Cognizable and Non-compoundable.
Triable By :
According to Para 1 – Court of Session.
According to Para 2 and 3 – Magistrate of the first class.
Punishment :
According to Para 1 – Imprisonment for life, or imprisonment for 14 years, with or without fine.
According to Para 2 – Imprisonment for 7 years, with or without fine.
According to Para 3 – Imprisonment for 3 years, or fine, or both.
