Definition of IPC 120B:
Punishment of criminal conspiracy.
Classification :
According to Para 1 – According as offence which is object of conspiracy is bailable or non-bailable, According as the offence which is the object of conspiracy is cognizable or non-cognizable and Non-compoundable.
According to Para 2 – This section is Bailable, Non-cognizable and Non-compoundable.
Triable By :
According to Para 1 – Court by which abetment of the offence which is the object of conspiracy is triable.
According to Para 2 – Magistrate of the first class.
Punishment :
According to Para 1 – Same as for abetment of the offence which is the object of the conspiracy.
According to Para 2 – Imprisonment for six months or fine, or both.
I am block development officer in Jharkhand. An enquiry team of district checked some of the MGNREGA schemes as mitti moorum road, pond, well… And reported that JCB machine was used in the schemes
FIR under section 467,468,469471,420and120(b)has been lodged against me and 5mukhiya,3panchayat Sewak, 5rojgar Sewak, 2 operators and 1 Nazir total17 people
Somebody is playing Court Police being behind the scene while committing all sorts of crimes. Can he be apprehended as a conspirator or something. Some body else signs so the police says he cannot be apprehended. I think 120a should put him behind bars. Please opinion?
